
It saved a group of New York students from a potentially long stint in prison. The New York Post reports.
The Hofstra freshman who had a raunchy restroom romp and then cried rape made up the twisted tale because she didn't want her schoolmates -- particularly her new boyfriend -- to think she was easy, the beau told The Post yesterday."I think she needs a psychologist. She probably felt like, 'They'll think I'm a slut,' " her boyfriend, who asked not to be identified, told The Post.
Danmell Ndonye, 18, who had accused five men of gang rape, admitted the truth only when prosecutors confronted her after learning of a cellphone video that captured the whole sordid episode and showed she had willingly participated, officials said.
If the young man who decided to video tape the group sex event had not done so, it's a pretty safe bet that these young black males would have been railroaded off to prison. As it is they're forever going to be stained by this accusation.
In cases like this the concept of "using protection" takes on a whole new meaning, since any girl crazy enough to willingly gang bang a bunch of guys in a bathroom is probably crazy enough to later make herself believe that she wasn't a willing participant.

There should be some repercussions for her actions. If there was no video she may have maintained her claims and these men may have had 25yr sentences and came out to be sex offenders with their lives absolutely ruined, that's if they weren't killed in jail or took their own lives. To think if she's let off with no charges, it just condones women everywhere that its okay to do this and regardless of how malicious their intentions were, there will be no punishment. Should men live their lives with hidden camera's or sexual contracts to be better safe than sorry? I think not. This fundamental flaw of our system has been hidden for a long time because it's a touchy subject that politicians are fearful to approach. It would be foolish to believe this is the only case of this happening, there needs to be a change and it needs to happen soon. Equal justice for both sides, don't offer the prosecution a sword and take the defendant's shield. Innocent until proven guilty, not guilty until proven, if this applies to all charges uniformly, why is rape an exception?
PS: Both parties actions may not have been morally right but that by no means constitutes the defendants being criminals. Where these kids learn this, probably from those California adult films with one woman taking on 30 men.

Since DNA testing started being used to review old cases it's been discovered that about a third of men convicted for rape are in fact innocent. The FBI found that in 25% of sexual assault cases referred to them the primary suspect was excluded by forensic DNA testing. Professor Eugene Kanin of Purdue University did a 9-year study of one Midwestern town and found woman there made false allegation in 41% of the rape cases. In a 1985 U.S. Air Force study it was found that 60% of rape allegations were false. More here and here.
You would think that such a high rate of false rape allegations lawmakers would give defenders is such case more safeguards, but the opposite is true. Defendents in rape cases have fewer rights than defendants in cases for any other crime. When there's clear case of a false accusation of rape the accuser should be charged with a crime as serious as rape. However, they are not even charged in most cases and if they are it's for some minor crime.
How does such injustice survive in our political system? Because men don't care enough to organize and protest. They think it's unmanly or embarrassing to complain about such a thing. And then of course many men don't think it could happen to them, you know, because they're so good with women. When it comes to sex men are so stupid (e.g., Bill Clinton).

Those are my issues with this girl, not in any order. First of all I don't see a problem with adults having whatever kind of fun they want in the bedroom. But this young and in a frickin Bathroom? Your kidding me???!! There is something wrong with the upbringing of these kids. Sexual experimentation is one thing at that age, playing doctor leads to playing truth or dare or spin the bottle, I mean less than a century ago kids still got married and had babies younger than this. But a frickin GangBang; What the hell?
I answered the age question above leaving me with the most important part of this article. Crying Rape should not be punishable. However in indisputable proof type situations Falsely crying Rape should be punished harshly, at the very least with filing a false police report and opening the girl up to civil suits from the accused.

I feel for the guys who could have spent years in prison for her lies. She definitely needs to be punished. She also needs mental help. Her parents needs parenting classes. Who the hell turned all these people loose onto the streets?

Put me down as one who think that those who clearly falsely accuse others of rape should be punish.
It wasn't too long ago that rape activist claim that a woman should be able to declare rape if they get themselves drunk(different from being pass out\incoherent and taken advantage of), felt pressured, or simply decided later she didn't really want to have sex.
