I can't help but be disappointed. Passing this would have reminded me of our early revolutionary spirit where the people took control of their government and destiny. A modern tea party if you will.

It was a serious mistake not to eminent domain his home. It would have brought crystal clarity to the court and no doubt provide them the impetus to revisit the issue with a much different result to the benefit of us all.

Souter would have fought it all the way to the supreme court if they had tried in earnest to take his home. How do you think he would come out of that? My guess is he would have won.

It wouldn't have got that far. The lower courts would have ruled in his favor and SCOTUS would have refused the case.
